President Bola Ahmed Tinubu Seeks Dismissal of Suit Demanding His Impeachment Over Alleged Rights Violations

President Bola Tinubu has requested the Federal High Court in Abuja to dismiss a lawsuit filed by legal practitioner Olukoya Ogungbeje, which seeks to compel the National Assembly to initiate impeachment proceedings against him over alleged human rights violations. The suit alleges that the administration suppressed peaceful protests between August 1 and 10, 2024, infringing on citizens' constitutional rights to freedom of assembly and expression. 


In response, President Tinubu and the Attorney General of the Federation, Lateef Fagbemi (SAN), filed a joint preliminary objection, arguing that the plaintiff lacks the legal standing (locus standi) to initiate the suit and failed to disclose any reasonable cause of action. They contend that the court lacks jurisdiction over the matter, asserting that impeachment proceedings are the exclusive domain of the National Assembly and not subject to judicial intervention. 

The defendants further argue that the plaintiff filed the action on behalf of "faceless citizens" without specifying individuals whose rights were allegedly violated. They maintain that only persons directly affected by an alleged rights breach have the standing to seek legal redress, as stipulated in Section 46 of the 1999 Constitution. 


In a counter-affidavit, Gbemga Oladimeji, a principal state counsel in the Federal Ministry of Justice, stated that the protests in question were peaceful and conducted within the bounds of a court order that confined demonstrations to a specific location. He emphasized that the Tinubu administration has been a promoter of democratic principles, allowing citizens to express their grievances through peaceful protests. 


The presiding judge, James Omotosho, has adjourned the case to March 4 to allow the plaintiff's counsel time to respond to the preliminary objections raised by the defendants.
